GENERAL DATA PROTECTIONS REGULATION

Although Enerco (“We” or “Us”) does not have a presence in the EU/EEA, we do engage with some companies who do or who have customers and data subjects in the EU/EEA, any of which may be covered under GDPR. In such instances, Enerco may process or control an EU citizen’s user information (“Data” as defined below) under a valid legal basis such as a contract to provide such services, with the consent of the EU citizen or for a legitimate interest.

This GDPR Privacy Policy and its enumerated provisions along with our Privacy Policy are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of all of our users’ information in accordance with GDPR. Data as defined in this policy means the GDPR definition of personally-identifiable information such as an EU/EEA citizen’s name, address, email address, phone number, and IP address or other similar data.

Data collected on the basis of consent

Upon your request and expression of consent, we collect the following Data for the purpose of providing services to you. Your Data is not used for any other purposes or shared with third parties. It is removed upon your withdrawal of consent or your request to terminate theses services.

Newsletter Subscription

Your email address is collected when you sign up to receive our newsletter.

Account Setup

If you register an account with us, we collect your name, shipping and billing address, email address, and phone number. We will also keep a record of purchases you have made on our site.

If you create an account on any of our Sites, your name and email address will also be saved in cookies. These are for your convenience so that you do not have to fill in your details again the next time you sign in. These cookies will be saved on your computer until you delete them.

IP and browser user agent string: We collect this data when you create an account on our Sites.

This is a piece of data that helps identify what browser you are using, including the version, and operating system of your computer. This information cannot be tied back to a user account and is used for monitoring and logging purposes only.

Retention period: The aforementioned data is retained for nine weeks.

Data collected on the basis of legitimate interest

Based on our legitimate interests, we collect the following Data for the purpose of running our Sites. Your Data is not used for any other purposes or shared with third parties. It is removed upon your request.

Statistics

The Sites use Google Analytics, a service which transmits website traffic data to Google servers in the United States and allows us to notice trends to improve the user experience on our Sites. This minimal build processes personal data such as: the date and time of the users’ visits, the network location and IP address, the title of the page being viewed, the URL of the page being viewed, the URL of the page that was viewed prior to the current page, the screen resolution, the time in local time zone, the files that were clicked on and downloaded, the links clicked on to an outside domain, the type of web browser, the type of operating system, the type of device, and the country, region, and city.

Additionally, when you download podcasts from our Sites, we track how many downloads were made by any given user for purposes of supporting the Sites and identifying user preferences for certain content.

Your Rights

If you are resident of the EU/EEA, you have specific rights including the following:

The right to access – You have the right to request from us copies of your Data. We may charge you a small fee for this service.

The right to rectification – You have the right to request that we correct any Data you believe is inaccurate. You also have the right to request that we complete the Data you believe is incomplete.

The right to erasure – You have the right to request that we erase your Data, under certain conditions.

The right to restrict processing – You have the right to request that we restrict the processing of your Data, under certain conditions.

The right to object to processing – You have the right to object to our processing of your Data, under certain conditions.

The right to data portability – You have the right to request that we transfer the Data that we have collected to another organization, or directly to you, under certain conditions.

In some instances, Enerco may require explicit consent from you to process certain Data. In such instances, you will receive a direct request from Enerco for your permission to collect and/or process your Data and you will be required to provide affirmative consent. In any event, Enerco will clearly explain what Data is being collected and/or processed and how it will be used. Enerco only collects a minimum amount of user information necessary to perform its services. Explicit consent may always be retracted at any time by data subjects covered under GDPR.

Changes to GDPR Privacy Policy

If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this website prior to the change becoming effective.
